Notary Charges (Rate chart)-Massive Loot !!

Massive loot in the name of Notary Charges by Notaries all over the country.

Each Notary does atleast 50 notings per day. If he loots Rs 200 per noting, he easily loots Rs 10,000 per day !!

All of us have used the services of a Notary for availing various services like attestation of documents, Notarizing of documents, Affidavits etc., and most of us have paid whatever the Notary demanded from us without even questioning the basis of those rates.
Most people are not aware that all the rates of a Notary are fixed via THE NOTARIES RULES, 1956.

Not only this, all Notaries are supposed to give you a receipt for the same and display on a notice board the charges for all the documents as stated below.One way to catch the scam is to ask for a Bill from the Notary which clearly states the service provided along with the amount charged.

The receipt shown below was obtained from a Notary after we were told that charges for Notarizing an Indemnity Bond for real estate on a Rs 100 Stamp Paper would be Rs 250/- (Excluding the stamp paper charges). After a lot of verbal arguments we managed to obtain the receipt below. The Price of Notary Stamps is to be paid according to the stamps fixed on the document. On our document,stamps worth Rs 25 were fixed and Rs 35 was the govt specified charges for Notarizing. Hence the total charges we paid were Rs 60.

At one stage, the lawyer got so angry that she wanted to take back the notarized papers from us and cancel the same, but we told her to buzz off as we already had the receipt in our hand 😄

Every Notary Notarizes atleast 50 to 100 documents daily. If we assume that the notary loots Rs 200 per document, this scam adds up to Rs 10,000 per day/per notary. If you add up all the notaries in the state of Maharashtra, this loot racket alone totals up to hundreds of crores per day 😆

Why does DM (District Magistrate) not conduct raids on these Notaries ?
Why does DM (District Magistrate) check how many Notaries have actually put up the boards of official rates ?
Why are these looters allowed to carry on unfettered ?
How much money bribe they pay to higher authorities every month ?

Notary Charges Board

 

Every notary may charge fees not exceeding the rates mentioned below, namely,-

(a) for noting an instrument –
if the amount of the instrument does not exceed rupees   10,000 Rs.35/-
if it exceeds rupees 10,000 but does not exceed rupees 25,000 Rs.75/-
if it exceeds rupees 25,000 but does not exceed rupees   50,000 Rs.110/-
if it exceeds rupees 50,000 Rs.150/-
(b) for protesting an instrument –
if the amount of the instrument does not exceed rupees 10,000 Rs.35/-
if it exceeds rupees 10,000 but does not exceed rupees   25,000 Rs.75/-
if it exceeds rupees 25,000 but does not exceed rupees 1,00,000 Rs.110/-
if it exceeds rupees 1,00,000 Rs.150/-
(c) for recording a declaration of payment for honour Rs.75/-
(d) duplicate protests half the charge for original
(e) for verifying, authenticating, certifying or attesting the execution of any instrument Rs.15/-
(f) for   presenting any promissory note, hundi or bill of exchange for acceptance or payment or demanding better security Rs.35/-
(g) for administering oath to, or taking affidavit from   any person Rs.15/-
(h) for preparing any instrument intended to take effect   in any country or   place outside India in such form and language as may conform to the law of the place where such deed is intended to operate Rs.150/-
(i) for   attesting or authenticating any instrument to take effect in any country or place outside India in such form and language as may conform to the law of the place where such deed is intended to operate Rs.150/-
(j) for   translating and verifying   the translation of any document form one language to another Rs.75/-
(k) for noting and drawing   up ship’s protest, boat protest or protest relating to demurrage and other commercial matters Rs.150/-
(l) for   certifying copies of document as true copies of the original Rs.5/- per page minimum Rs. 10/-
(m) for any other notarial act

 

 

 

such sum as the appropriate government may fix from time to time.

Every Notary is also supposed to maintain a Notarial Register in the format as required by the govt (Form XV).The first Page of the Register is supposed to mention the number of pages in the Register.

Even the columns in the register have to be with the following headings:-

  • Serial Number
  • Date
  • Type of Notarial procedure (affidavit,attestation,bond etc)
  • Name of Executant (person who signs on the document) along with full address.
  • Contents of documents.
  • Notarial Stamps affixed on the documents.
  • Fees charged for the same.
  • Serial Number of the same in Receipt book maintained by Notary.
  • Signature of person concerned.Signature of Notary.

The State govt fixes the number of Notaries in the state.

The complaint should be in the following format,but as is the case in this country,it will fall on deaf ears as everyone is getting a cut from top to bottom.
